STOP VIOLENCE AND HUMAN RIGHTS VIOLATION ON INDIGENOUS PEOPLE AROUND MINING AREA IN WEST MANGGARAI, MANGGARAI, AND EAST MANGGARAI OF EAST NUSA TENGGARA PROVINCE

On September 13, 2014, there has been violence committed by the unit Sabhara Police of Ruteng and military personnel from the District Military Command 1612 Ruteng on Lingko Roga community, Tumbak sub-village, Satar Punda village, Lamba Leda sub-district, East Manggarai regency. The violence was triggered by the company's efforts, namely PT. Aditya Earth Mining to bring heavy equipment for drilling into customary land owned by the residents (Lingko Roga). The effort got a rejection from residents who have done a posse to maintain their Lingko since September 11, 2013.
 
Residents who tried to defend their communal land was persuaded by government officials, ranging from the village head, district head, police and military forces. Residents, along with the Justice, Peace and Integrity of Creation (JPIC) Commission of SVD Ruteng, hold on their ground. They did worship together at the location. The persistence of these residents made the apparatus and the company could not be patient. At 5 pm, dated 13 September 2014, 5 company’s cars which backed up by police car forced their way into the site. Peace action of the residents faced with violence by the authorities. The police forced people to dissolve the posse, by pulling forcefully and shouting. In fact, a police officer from Dampek, BRIGPOL(Police Brigadier) JONATHAN NILA persecuting a religious leader / Coordinator of JPIC Ruteng SVD, Fr Simon Suban Tukan until he fainted.

Similar violence done by the police in NTT has occurred repeatedly without decisive action both ethical and legal of the police chief, both the Regional Police of NTT and the National Police Headquarter. Even the National Commision on Human Rights and the Ombudsman have repeatedly issued a recommendation to stop the violence by police officers against civil society, especially indigenous peoples around the mining area in Flores, Lembata, Timor and Sumba. However, these recommendations were ignored.

Based on the above facts, we are the NATIONAL SOLIDARITY FOR NTT COMMUNITY :

I. THE NATIONAL COMMISSION ON HUMAN RIGHTS (KOMNAS HAM)

FIRST, URGE THE KOMNAS HAM TO OPENLY REVEAL ANY FORMS OF HUMAN RIGHTS VIOLATIONS AND VIOLENCE HAPPENS IN TUMBAK AND AROUND THE MINING AREA IN THREE REGENCIES : MANGGARAI, EAST MANGGARAI, AND WEST MANGGARAI.

SECOND, ASK THE KOMNAS HAM TO URGE THE CHIEF OF NATIONAL POLICE (KAPOLRI) TO FIRING THE CHIEF OF MANGGARAI RESORT POLICE (KAPOLRES), ADJ SABHARA OF MANGGARAI RESORT POLICE WHO INDICATED NOT NEUTRAL IN IMPLEMENTING THE TASK AND DOING VIOLENCE AND INTIMIDATION TO THE TUMBAK RESIDENTS.

THIRD, SPECIFICALLY ASK KOMNAS HAM TO URGE THE KAPOLRI Cq. KAPOLDA (THE CHIEF OF REGIONAL POLICE) OF NTT TO DO LITIGATION TO THE CHIEF OF DAMPEK SECTORAL POLICE AND POLICE BRIGADIER JONATHAN NILA WHICH ALLEGEDLY DOING VIOLENCE AND HUMAN RIGHTS VIOLATIONS AGAINST TUMBAK RESIDENTS, EAST MANGGARAI, NTT.

FORTH, ASK KOMNAS HAM TO URGE THE REGENTS OF WEST MANGGARAI, MANGGARAI, AND EAST MANGGARAI REGENCY TO REVOKE ALL MINING PERMITS (IUP) THAT HAS RELEASED AND SHOULD NOT ISSUE NEW IUP.

II. THE CHIEF OF NATIONAL POLICE (KAPOLRI)

FIRST, URGE THE CHIEF OF NATIONAL POLICE (KAPOLRI) AND THE CHIEF OF REGIONAL POLICE (KAPOLDA) OF NTT, TO FIRING THE CHIEF OF MANGGARAI RESORT POLICE (KAPOLRES), ADJ SABHARA OF MANGGARAI RESORT POLICE, THE CHIEF OF DAMPEK SECTORAL POLICE AND POLICE BRIGADIER JONATHAN NILA, POLICE OFFICER OF DAMPEK SECTORAL POLICE WHICH  DOING HUMAN RIGHTS VIOLATIONS AND VIOLENCE TO THE TUMBAK RESIDENTS, EAST MANGGARAI, NTT.

SECOND, URGE THE KAPOLRI AND KAPOLDA NTT TO IMMEDIATELY ARREST AND LEGAL PROCESS THE SUBJECT AND INTELLECTUAL ACTOR OF THE LOOTING OF COMMUNAL LAND OF INDIGENOUS PEOPLE IN MINING AREA IN THREE REGENCIES, WEST MANGGARAI, MANGGARAI, AND EAST MANGGARAI.

III. THE REGENT

URGE THE REGENTS OF WEST MANGGARAI, MANGGARAI AND EAST MANGGARAI TO REVOKE ALL MINING PERMITS (IUP) THAT HAS RELEASED AND SHOULD NOT ISSUE NEW IUP.

IV. THE ELECTED PRESIDENT OF REPUBLIC OF INDONESIA

URGE THE NEW GOVERNMENT OF JOKO WIDODO (PRESIDENT) AND JUSUF KALLA (VICE PRESIDENT) TO SETTING A NATIONAL POLICY FRAMEWORK TO PROTECT, RESPECT AND RESTORING THE SOCIAL, ECONOMIC AND CULTURAL RIGHTS OF INDIGENOUS PEOPLES, FROM NEGATIVE IMPACT OF EXTRACTIVE INDUSTRY PERFORMANCE OF MULTINATIONAL, NATIONAL, AND LOCAL COMPANIES BASED ON UN RESOLUTION NO. 17/4, DATE 16 JUNE 2011 (UNITED NATIONS GUIDENCE PRINCIPLES) OF BUSINESS AND HUMAN RIGHTS THAT HAS SIGNED BY INDONESIA GOVERNMENT
